    Did you notice he gets this very basic point completely wrong? The reason you can’t shout “fire” in a crowded theater is not because people will be trampled, it is because, in this example, it is assumed your INTENT is to cause disruption.

    If you shout “fire” and there’s no fire, it’s perfectly OK as long as you believed there was a fire, that your intent was to save lives.

    Is there a more basic legal concept than this?

North Canton, Ohio – The event the day after Labor Day was billed as a town-hall meeting, the third in recent weeks for Republican Jim Renacci as part of his campaign to unseat Rep. John Boccieri, the freshman Democrat from Ohio’s 16th Congressional District.

It also turned out to be a case study for a widely used brand of political high jinks that has a whiff of dirty tricks and a dollop of unregulated citizen journalism heated by the blogosphere and brought to a boil by the searing partisanship of a high-stakes campaign season. It is a phenomenon that has candidates in both parties watching their every step amid signs that voters’ unscripted access to those who would represent them could be waning.

Mr. Renacci, facing an audience of about 100 at the North Canton Civic Center, opened by noting the presence of an Ohio Democratic Party activist with a video camera. He then launched into his stump speech.

But after fielding just one question, the surprises began for Renacci, a businessman and former mayor. Unexpectedly, Representative Boccieri showed up for what suddenly became the first face-to-face debate of the campaign. He told the audience his schedule had freed up early that night and he had decided to accept the longstanding invitation to participate. What he did not say was that his staff had also held a meeting that evening at their own headquarters to prepare 30 recruits to ask tough questions from the audience. The topics ranged from taxes and free trade to abortion rights.

Then came the evening’s seminal moment, as videotaped by a blogger and posted on YouTube en route to the national media and a shot at tipping a too-close-to-call race.

The audience fell silent as Robert Thompson, one of only two African-Americans in the room, rose to ask Renacci a question. Mr. Thompson, who did not introduce himself, is the political director of an Ohio branch of a national public employees union and was a delegate for Hillary Rodham Clinton at the 2008 Democratic National Convention. He had also been in attendance earlier that evening at the meeting at Boccieri headquarters, though he later maintained in an interview with The Christian Science Monitor that his question was his own and not planted.

The arrests were the latest twist in a scandal that emerged in July with the disclosure that City Manager Robert Rizzo was paid nearly $800,000 a year -- almost twice the salary of President Barack Obama.

Since then, authorities have been investigating allegations of corruption, misuse of funds, racial profiling and voter fraud in the city where one in six of the 40,000 residents live in poverty.

It also was revealed that former Police Chief Randy Adams was making $457,000 a year, and Assistant City Manager Angela Spaccia was paid $376,288. Four of the five City Council members paid themselves nearly $100,000 a year for their part-time service.

Former Bexar County Democratic Party Treasurer Dwayne Eugene Adams was indicted Wednesday on charges that he embezzled and misused about $202,000 of party funds.

Adams, 55, could face up to 20 years in prison if convicted of theft between $100,000 and $200,000 and misapplication by a fiduciary between $100,000 and $200,000. Each charge is a second-degree felony.

The grand jury action came as little surprise, Democratic Party officials acknowledged.

Rep. Barney Frank, immersed in one of the toughest political fights of his career, took a free private jet to the Virgin Islands courtesy of a Maine congresswoman’s billionaire fiance — whose company received a $200 million federal bailout, the Herald has learned.

Frank, who’s facing feisty Republican challenger Sean Bielat, flew to the tropical paradise for a vacation in 2009 on a $25 million jet owned by Paloma Partners honcho S. Donald Sussman, the fiance of U.S. Rep. Chellie Pingree (D-Maine). Paloma Securities — a subsidiary of Sussman’s Greenwich, Conn.-based hedge fund — received $200 million in 2009 as part of the $180 billion federal bailout of troubled insurance giant AIG, records show.

Frank, who chairs the House Financial Services Committee, said his partner, Jim Ready, lives in Pingree’s district and the couples are “personal friends.”

Jon Stewart raised a lot of eyebrows over the weekend when the “Rally to Restore Sanity” showcased Yusef Islam, a.k.a. Cat Stevens. Islam has over the years said a lot of radical things including a number of comments where he essentially endorsed the infamous fatwa against Booker-Prize-Winning novelist Salman Rushdie. Islam has since tried to backpedal, but it’s hard to disguise his radicalism. (For more on Islam’s slippery defense of his comments, see Michael Weiss at The New Criterion.)

Anyway, Rushdie was sufficiently perturbed by Yusef Islam’s appearance at the Rally to Restore Sanity that he called Jon Stewart to discuss the matter. Here’s how Rushdie described their conversation to Nick Cohen at Standpoint magazine:

    I spoke to Jon Stewart about Yusuf Islam’s appearance. He said he was sorry it upset me, but really, it was plain that he was fine with it. Depressing.

SEATTLE -- Recently obtained police reports document a hit-and-run collision involving community leader Bill Gates Sr.

The Seattle Police Department investigation reports show the father of one of the richest men in the world wasn’t there the night of Aug. 16, when investigators found his car near Seattle Center, wedged against the car in front of it -- with the engine running and keys still in the ignition.

The owners of the other car involved in the incident called 911 when they realized their car couldn’t move because Gates’ 2003 Mercedes 500 was wedged against their car.

They told dispatchers:
"Somebody has crashed into the back of our car, and their vehicle is still running, and there is nobody anywhere near it."
Operator: "What street are you on?"
Answer: "Third and Mercer."
Operator: "And no injuries that you can tell?"
Answer: "No, there’s nobody here."

The collision report indicates that police came out, investigated, had Gates’ car towed away and sent the family on their way. The report also notes that Gates’ car was parked illegally in an area marked "Tow away zone, no stops."

A short time after officers left the scene, they were advised that Gates and someone listed as a friend or companion had returned to find his car was gone. The officer documented that the Gates didn’t realize his vehicle was in a tow zone or was pressed against the other car. After the officers explained the damage, saying both vehicles had deep scrape marks and slight cracking, Gates' companion/friend advised that Gates may have had a "senior moment and didn’t think he was close to the other vehicle."

Feds Admit $125 Billion in Bogus Payments, Call It 'Progress'

President Obama has claimed that one way he'll pay for his new health-care program is by eliminating waste, fraud and abuse in existing programs. Unfortunately for Hope and Change, tucked away in the sixth paragraph of a press release from the Office of Management and Budget is the admission that "improper payments" -- federal money paid to the wrong people, whether through fraud or error -- actually increased last year:

    Now, because many of the targeted programs - such as Unemployment Insurance and Medicaid - are paying out more benefits as the economic downturn creates more demand for these benefits, the total number paid out in improper payments increased to $125 billion last fiscal year even though the overall error rate declined. This is an unfortunate result of the recession and of basic math: the more that is paid out, the more paid out in error even if the overall rate declines.

During an exclusive dinner hosted Monday by the Alfalfa Club, Obama adviser Valerie Jarret had just such a moment. And were it not for an irritated tipster, Jarret might have walked away from the dinner unblemished.

According to our tipster, Jarrett was seated at the head table along with several other big-name politicians and a handful of high-ranking military officials. As an officer sporting several stars walked past Jarrett, she signaled for his attention and said, “I’d like another glass of wine.”
