SCOTUS Knocks Down McCain-Feingold - NRO

The Supreme Court today struck down key elements of McCain-Feingold legislation in a decision that could radically alter campaign finance.

In a broad 5-4 decision in Citizens United vs. FEC, the Court found unconstitutional bans in the Bipartisan Campaign Reform Act that prevented corporate and labor union money from funding some kinds of political communication. Under the ruling these groups may now fund political advertisements out of their general treasuries.


It appears that the restrictions on spending within specified limits around election dates have also been struck down.

For me this was the WORST non veto of the Bush administration.  It allowed the Soros/lefty money stream to pollute our political process.  What's scary it was a 5-4 decision - four justices on the Supreme Court think it's perfectly ok for Congress to trample the first amendment.  Mitch McConnell made a bunch of noise when the bill was passed but he could have stopped it with a filibuster. The elected branches need to quit relying on the judicary to fix things.  Thank God for this decision.

McCain also reaped the consequences of his own stupid bill last year.  This should enable the RNC to advertise provided the Chairman hasn't alienated his donor base to the point where he doesn't have any money to advertise.

We saw the effects of the left money here in Virginia.  Virginia actually voted for a democrat presidential candidates since 1964.  2 US Senators are now democrats as well as the State Senate.  Hopefully Bob McDonnell's victory can put Virginia on the road back

Thomas' shed's light on how part IV of the court's decision isn't reconcilable with their recent Prop 8 opinion.  Public registries do nothing more than create potential victims of those to whom they apply (campaign donations, gun registries, etc.)

The ending of Thomas' opinion:

I agree with Thomas but this is a remarkable step forward.

The real scary thing is that 4 justices actually believe MF was ok.

The difficulty may be finding a way to solve the second half of the equation. As you saw yesterday, most of Congress got defensive.  I don't see Congress getting rid of the individual's contribution limitations any time soon.  Hopefully some wealthy individual will sue the government on 1st Amendment grounds for violating their rights.

That's what it would take to remove the individual restrictions (someone making a complaint).  The Court can only rule on what's before it.  At least the playing field has been leveled somewhat and the lefty Soros Acorn bilge can be countered.

CTH started back in 2004.   Looking back at 2004, one can see the initial effects of McCain Feingold.  It was a little too close for comfort in Ohio that should have been a wake up call.  If a creepy jerk like John Kerry and his slimy sidekick John Edwards came just 100,000 votes from taking the big prize, it's no big leap to see how a charismatic demagogue like Obama could do it in 2008.

Actually I've seen some funny posts out there how Politicians will need to start putting corporate stickers on themselves like NASCAR.  The leftists will have to use Union stickers like SEIU/NEA etc.

I've also read somewhere the only growth industry has been K street here in Washington.  Way to go John (McCain) - you really took the money out of politics.

Amazing idea. They should have an action figure line with each politician wearing his sponsor jacket.
